HIPAA Notice of Privacy Practices

Your Information. Your Rights. Our Responsibilities.

This notice describes how your medical information may be used and disclosed, how you can access your information, and your rights regarding your medical records. Please review it carefully.

1. Our Commitment to Your Privacy

Cure MedicalCare, PC (“Cure MedicalCare,” “Cure,” “we,” “us,” or “our”) is committed to protecting the privacy and security of your personal health information.

We are required by law to maintain the privacy of protected health information (PHI), provide this Notice of Privacy Practices, comply with the notice currently in effect, and notify affected individuals of breaches of unsecured PHI as required by law.

This notice applies to medical information maintained by Cure MedicalCare and its authorized healthcare professionals, employees, and business associates acting on its behalf.

Protected health information may include medical histories, diagnoses, laboratory results, prescriptions, treatment plans, appointment information, insurance information, and healthcare billing records.

2. Your Medical Privacy Rights

Access Your Medical Records

You have the right to inspect and obtain copies of your medical records in electronic or paper form, subject to applicable legal exceptions.

For qualifying requests involving California medical records, copies generally must be provided within 15 days, as required by California law.

We may charge reasonable, legally permitted fees for certain record requests.

Request Corrections

If you believe your medical information is inaccurate or incomplete, you may request an amendment.

We will review your request and respond according to applicable law. If your request is denied, we will explain the reason and your available rights.

Request Confidential Communications

You may request that we contact you through a particular telephone number, mailing address, or other appropriate communication method.

We will accommodate reasonable requests for confidential communications.

Request Restrictions on Disclosure

You may ask us to limit certain uses or disclosures of your medical information.

We are not always required to agree, except where applicable law requires a restriction.

If you pay in full out of pocket for a particular service or healthcare item, you may request that we not disclose information about that service to your health insurance plan for payment or healthcare operations purposes. We will honor qualifying requests unless disclosure is required by law.

Request an Accounting of Disclosures

You may request an accounting of certain disclosures of your PHI during the preceding six years.

Certain disclosures, including many disclosures for treatment, payment, or healthcare operations, are excluded as permitted by law.

One accounting will generally be provided without charge during a 12-month period. Reasonable, legally permitted fees may apply to additional requests.

Receive a Copy of This Notice

You may request a paper or electronic copy of this Notice at any time.

Designate a Personal Representative

A person legally authorized to act for you may exercise applicable privacy rights on your behalf. We may verify that person's authority before releasing information.

Special confidentiality protections may apply to medical services provided to minors.

3. How We May Use and Disclose Your Medical Information

Applicable law generally permits us to use and disclose PHI without separate written authorization for treatment, payment, and healthcare operations, subject to additional protections for certain records.

Treatment

We may use and share your medical information to provide, coordinate, or manage your healthcare.

This may include communication with authorized clinicians, laboratories, pharmacies, specialists, imaging centers, and other providers involved in your care.

For example, your provider may review laboratory results and discuss relevant findings with another clinician participating in your treatment.

Payment

We may use and disclose relevant information to process healthcare payments, insurance claims, membership-related medical billing, and other lawful payment activities.

Healthcare Operations

We may use medical information to operate our practice, improve patient care, maintain clinical quality, conduct permitted audits, manage scheduling, and comply with regulatory requirements.

We may use qualified service providers to perform authorized functions on our behalf. Where required, these providers must enter into appropriate agreements protecting patient information.

4. Other Uses and Disclosures Permitted or Required by Law

Under certain circumstances, we may use or disclose PHI for purposes including:

  • Public health reporting, disease prevention, and medication safety.

  • Reporting suspected abuse, neglect, or other matters required by law.

  • Reducing a serious threat to health or safety.

  • Health oversight, licensing, audits, and regulatory investigations.

  • Research activities permitted by applicable law.

  • Workers' compensation matters.

  • Organ and tissue donation coordination.

  • Coroner, medical examiner, or funeral director responsibilities.

  • Certain law enforcement and governmental requests.

  • Compliance with valid court orders, subpoenas, or other lawful legal processes.

  • Disclosures to the U.S. Department of Health and Human Services for HIPAA compliance oversight.

All such disclosures are subject to applicable legal requirements and any stricter confidentiality protections that apply.

5. Uses Requiring Your Written Authorization

We will obtain your written authorization before using or disclosing PHI when the law requires it.

Examples generally include:

  • Most uses or disclosures of psychotherapy notes.

  • Uses or disclosures of PHI for marketing when authorization is legally required.

  • Disclosures constituting a sale of PHI.

  • Other uses or disclosures not otherwise permitted by applicable law.

You may revoke a written authorization at any time by notifying us in writing, except to the extent that action has already been taken in reliance on that authorization or another legal exception applies.

6. Family Members, Caregivers, and Personal Preferences

You may tell us whether you want us to share relevant information with family members, close friends, caregivers, or others involved in your care or payment for your care.

We generally respect your preferences as required by law.

If you cannot communicate your wishes, we may disclose limited relevant information when permitted by law and when our professional judgment determines that doing so is appropriate.

We may also participate in legally permitted disaster-relief communications.

7. Special Protections for Sensitive Medical Information

Certain categories of medical information receive additional protection under federal or state law.

These may include:

  • Substance-use-disorder treatment records.

  • Certain mental health records and psychotherapy notes.

  • HIV and other specially protected medical information.

  • Certain reproductive and sexual health information.

  • Medical information involving minors who are legally authorized to consent to particular services.

We follow applicable special confidentiality and authorization requirements before accessing, using, or disclosing these records.

Substance-Use-Disorder Records — 42 CFR Part 2

Certain substance-use-disorder treatment records are protected by additional federal confidentiality requirements under 42 CFR Part 2.

When Cure MedicalCare creates, maintains, or receives records subject to Part 2, we handle those records according to applicable Part 2 requirements.

Where valid patient consent permits disclosure for treatment, payment, or healthcare operations, subsequent disclosures may be permitted under applicable HIPAA and Part 2 rules.

Part 2 records, or testimony describing their contents, generally may not be used or disclosed in civil, criminal, administrative, or legislative proceedings against a patient without the patient's legally sufficient written consent or an appropriate court order and accompanying subpoena or other legal mandate.

Additional consent requirements may apply to specially protected counseling records.

If Part 2 information is used for otherwise permissible fundraising, applicable advance notice and opt-out requirements will be followed.

8. Cure Complete Membership and Municipal Gym Collaboration

Cure MedicalCare offers medical memberships and may collaborate with independent organizations, including Municipal Gym.

Cure MedicalCare and Municipal Gym are separate service providers.

Participation in a collaborative membership does not authorize Municipal Gym employees to access your confidential medical records, diagnoses, laboratory results, prescriptions, or treatment plans.

Limited membership eligibility or administrative coordination may occur only through legally permitted processes and with any authorization required by law.

Medical decisions and medical record management remain the responsibility of Cure MedicalCare and its authorized healthcare professionals.

9. Patient Portal, Telehealth, and Electronic Communications

Cure MedicalCare may use secure electronic health record systems, patient portals, and telehealth technologies to deliver and coordinate healthcare services.

Access to PHI is restricted to authorized individuals with appropriate responsibilities.

You may receive appointment reminders, care coordination messages, or administrative communications consistent with applicable law.

When possible, confidential medical communications should be conducted through our designated secure patient portal or another approved secure communication method.

We encourage patients not to send detailed medical information through general website contact forms, public social media, or unsecured messaging channels.

10. Fundraising and Promotional Communications

If Cure MedicalCare conducts fundraising activities using PHI as permitted by law, patients will be provided with applicable opportunities to opt out of fundraising communications.

We will obtain written authorization before using PHI for marketing when such authorization is legally required.

Promotional communications unrelated to PHI are subject to applicable marketing and consumer privacy laws.

11. Our Responsibilities

Cure MedicalCare is required to:

  • Protect the privacy and security of PHI.

  • Limit uses and disclosures as required by law.

  • Maintain appropriate administrative, physical, and technical safeguards.

  • Provide patients with this Notice of Privacy Practices.

  • Notify affected individuals of reportable breaches as required by law.

  • Follow the terms of the notice currently in effect.

  • Respect applicable patient privacy rights and respond to valid requests.

We will not use or disclose PHI beyond what is described in this notice unless permitted by law or authorized by you in writing.

12. Changes to This Notice

Cure MedicalCare reserves the right to revise this Notice of Privacy Practices and apply the revised terms to PHI maintained by the practice, as permitted by law.

When the notice is updated, the revised version will be available through our website and upon request at our office.
